You Can Not Apply For Mortgage Loans Led To The Lifting Of Sales Contract Research Questions

This paper mainly studies problems consist in the current judicial practice when the mortgage loans of pre-sell contract of commercial building do not get the bank’s approval, analysis of the causes and put forward the corresponding solution. This paper makes an analysis of this problem from five aspects. The paper begins with the purpose of naming points out he specific types of disputes in the judicial practice in our country, in the case of the mortgage loans without going through approval procedures and lead to the rescission of pre-sell contract of commercial building and the existing problems which the judicial organs have in dealing with such disputes and the corresponding solution. The second part of the paper the theoretical and legislative basis of the rescission of pre-sell contract of commercial building in the case of the mortgage loans without going through approval procedures. The third and fourth part put forward the principles and specific processing method the judicial organs should follow, and some advice about how to perfect the related system and expect to provide guidance for our current judicial trial.
