| With the increasing development of maritime transport activities, there is a phenomenon that the marine insurance is turning into a compulsory way. As an important part of the marine compulsory insurance system, the wreck removal compulsory insurance is attracting as much attention as it can be. The highly anticipated "Nairobi Convention" will also come into force within one year, after which, even if China does not accede to the Convention, China’s ships also need to hold a certificate when they sail into the applicable area. Therefore, our country should be prepared to deal with various problems in different ways.The first chapter introduces the basic theory of compulsory insurance system. After the introduction of the concept of "maritime compulsory insurance system", we explain the necessity to develop a mandatory insurance system to clear the wreckage, and establish the legislative situation of wreck removal compulsory insurance system.The second chapter analyzes the debris wreck removal compulsory insurance system from the theoretical definition. After the introduction of the system of "direct action", we make it clear that it is the core issue of the wreck removal compulsory insurance system.The third chapter describes the situation and limitation of the current property security system of the wreck removal compulsory insurance system, and we will discuss whether it is necessary to establish a compulsory system. After we compare the legislative model of other countries’ with China’s legislative system, we figure that China needs to establish the system as soon as possible, or we will fall far behind the legislative trends of the world. |
