Peasant workers’ back pay issue has received extensively attention of the whole society.However, the phenomenon of "unpaid wages every year " seems to be an unbreakablecycle. On the one hand, peasant workers’ back pay problem seriously damage thelegitimate rights and interests of migrant workers. On the other hand it leads to massincidents extremely and easily, affects the construction of a harmonious society. To ensuremigrant workers got paid on time and in full, protect their legitimate rights and interestsand social stability. On January22,2013, the Supreme People’s Court released on theapplicable law about criminal cases of refused to pay the labor remuneration, theexplanation of some issues for refusing to pay labor remuneration sin made relevantcriminal law applicable standards, for it involves terms, standards and criterion for theconviction of unit crime problems such as further defined. At the same time, sinceNovember20,2013, Human Resources and Social Security Ministry, the Ministry ofPublic Security, Urban and Rural Construction Ministry, the Ministry of Transport,Ministry of Water Resources, the State-owned Assets Supervision and AdministrationCommittee of the State Council, the State Administration for Industry and Commerce andthe National Federation of Trade Unions and other departments across the countryorganized the migrant wages payments special inspection, and achieved good social effect.Peasant workers’ back pay not only become the concern of the whole society, but also thelaw in-depth discussion.This paper uses case analysis, comparative research, investigationand study, etc. The method of theory with practice, especially combined with "Little Bird"Conciliation Committee in the process of aid workers work accumulated cases andstatistical data, through the investigation about the present situation of peasant workers’back pay.
