Criminal libel is divided into the narrow and broad sense,China’s “criminal law”the246th libel provisions is the narrow sense criminal libel.With the social progress and theconstruction of democratic politics, the reform of our country criminal libel law will alsobe more profound.The exploration and practice of the western countries in the criminaldefamation legislation to reform and improve, the reform results,such as“Decriminalization of defamation”、“Constitution of criminal defamation laws”and soon,have achieved good social effect and influence, and provides important reference formany national criminal libel law reform. Under the new situation, China’s criminal libellegislation in continuous improvement and development,but there are still some problemsand deficiencies.This paper will focus on issues and criminal libel legislation in ourcountry, the development of foreign criminal libel law reform trend and the mainachievements, our criminal libel legislation of how to reform and improve,and proposelegislation to improve our criminal libel suggestions and ideas.Around the above problems, this paper is divided into four parts for analysis andresearch:The first part mainly introduces our country criminal libel laws relating to libelspecies, purpose of legislation, constitution of crime, the reform goal and ways of the basictheoretical issues.The second part of the longitudinal analysis of underlying trends of foreign legislativereform criminal libel and achieved remarkable results.The third part focuses on China’s criminal libel problems and shortcomings existing inthe legislation.The fourth part Comprehensive comparative analysis of domestic and internationalstatus, put forward ideas and methods to the reform and improve of our country criminallibel law.
