Labor relations have entered into the stage of high-incidence season of labor conflicts and the prominent period of underlying problems since2010. Workers all over the country take collective actions more frequently after this year, and some of them even use their lives to defend their rights and interests.Labor collective action has three-level affects:the micro-level of workers and firms, the middle level of industrial structure and the macro-level of the whole society. To be specific, at the micro-level, interests of workers have been suffered severe losses, as well the development and the social image of firms are under threat; at the middle level, upgrade industries are tested; at the macro-level, the harmony and development of the whole society are impeded. Hence, the study of labor collective action has the urgency of the timeliness and reality, and also has a great realistic significance in these levels.Facing the complicated labor relations which accumulated in recent ten years, along with the short of effective Labor-capital Contradiction Adjustment Mechanism, the management, workers and the government all have no sufficient ability to adapt this complicated situation. Hence this study has an important theoretical significance in the following aspects:How to resolve and prevent the happening of labor collective actions in order to build a harmonious labor relations and even the harmonious society, to enrich and deepen the Labor-capital Contradiction Adjustment Mechanism and further to promote the attention in different sectors of the society.With the frequent outbreak of labor collective action, domestic scholars have a great keen on studying these events. However, most of them adopt the qualitative analysis or single case study method to analyze, and rarely of them take the quantitative analysis or multi-case study method to analyze such events. In this paper, the author collected430cases, classified them, and summed up the overall conditions, characteristics and inducements of these cases. And, as for the analysis of the reasons of labor collective action, few scholars interpret this problem from the perspective of the new institutional economics, hence this paper attempts to analyze the behavior of both sides of labor and capital under the existing institutional environment from that angle of view.This paper is divided into six chapters, and the specific content of each chapter is as follows:The first chapter is introduction. Firstly, analyze the background and significance of the labor collective action. Then define two concepts which are closely associated with this paper:labor relations and labor collective actions. On the research methods, mainly adopt literature research, case study and comparative analysis.The second chapter is literature review. Foreign researches on this issue are not only earlier, but also deeper and more comprehensive and have already formed a systematic theory, such as Max’s industrial capitalism theory, Webers’ industrial democracy theory and Commons’s collective action theory. Empirical research on strike problems in all walks of life is the main research trends and these researches also including china’s strike problems. Domestic researches are still in the exploratory stage, and also have much work to do, especially in empirical research field.The third chapter is the analysis on the overall condition of labor collective action. All the data come from network and newspapers, from2011to2012. Through the classification with the430cases, this paper summed up the overall conditions and characteristics of china’s labor collective action.The fourth chapter is the cause analysis. Firstly, through the classification, causes are divided into nine types, and then this paper focuses on the first two types:the salary and welfare, and economic compensation. The former is the primary cause and subdivided into twelve small classes; the latter is the second cause and subdivided into seven small classes. On this basis, this paper analyzes the causes of different Enterprise property rights and four major industries.The fifth chapter is the core part of this paper, analyzing the underlying reasons of labor collective action from the perspective of new institutional economics theory. Firstly, introduce the institution background of these actions, and then explain the reasons that workers take confrontational ways to defend their right instead of the regular ways, and explain why does the unlawful act of capital happen so often? Through the analysis, it is concluded that the lower cost of break law is the root cause of capital under the existing institution, and for workers, the reasons they choose the outside ways are the same. Last part of this chapter analyzes the deep institutional causes of such events.The last chapter is countermeasures and suggestions. Combined with the previous chapter, this chapter puts forward countermeasures and suggestions from three sides:labor, capital and government.
