Along with economic globalization and the knowledge economy tide, the term intellectual property is becoming a hot spot right now in the eyes of the multinational companies, major multinationals through intellectual property to seize the market, grab huge profits. In this trend surprise development, multinational abuse of intellectual property issues have been exposed in people’s eyes, attracted much attention. Countries have stepped up the development of relevant laws to regulate it in order to win in the foreign trade favorable position. China since joining the World Trade Organization, to expand market reach, open door policy, multinational corporations have sprung up in the Chinese market. However, implementation of patent strategy for multinational enterprises to survive and develop our country has posed a serious challenge. Therefore, how to regulate multinational patent abuse has become imperative. Right to regulate multinational patent misuse must be multi-disciplinary approach, major efforts to act. We should first carefully study the abuse of intellectual property in the world and finds scoping situation in which what behaviors are multinational patent abuse; Secondly, the reference for countries in the abuse of intellectual property laws and various aspects of governance measures, ranging from legislation, judicial, law enforcement perspective, improve multinational abuse of intellectual property legal framework regulation. Again, in the analysis of the regulation of the legal status of patent misuse multinationals after, pointing out the deficiencies of existing legal norms; finally, from my foreign national conditions, induction of Chinese multinationals abuse of intellectual property legal regulation effective proposals and measures in order to improve our regulation on multinational patent misuse helpful.
