At the "2011blue book published under the rule of law and Chinese rule of law development and outlook seminar" hosted by Chinese academy of social sciences, it released "the rule of law development report No.9(2011). It points out that television is commonly overtime with illegal advertisements,so it is urgent to strengthen the regulation of television advertising under the rule of law. Phenomenon such as less and less public service ads, more and more ads of alcohol tobacco and other highly profitable advertising, advertising language nonstandard, disguised forms of television news reports. In this case, illegal overtime advertisements on television should more regulated. This article mainly focus on the nature of the illegal advertisements overtime rom the television, the types of liability, responsibility and how to solve illegal behavior of television commercials overtime This article aims at the perfection of relevant laws and making a little contribution to protect television viewers by more clearly illustrating this phenomena and profits of TV viewers adjudication. In this paper, the specific contents are listed as following:The introduction part tells the status quo of television commercials in our country and related research briefly, points out the purpose and significance of topics,and introduces the general point of view in this paper.The first chapter is an overview of television illegal advertisements overtime and the analysis of the nature. Also it comes to the concept of television advertising and illegal timeout in the present situation, cause, harm and negative impact. It mainly analyze the aspects of breach of contract and toothwort nature of the illegal advertisements overtime,.The second chapter is about the responsibility of the overtime, constitutive requirements and the responsibility of television illegal advertisements. Specific speaking,it tells why should bear administrative responsibility, the cause of the civil liability, constitutive requirements and responsibilities.The third chapter talks about responsibility of illegal TV commercials mechanism overtime by dividing it into private interest litigation and public interest litigation. The former part focus on how to remedy, and the second part talks about the feasibility of public interest litigation,the reasons of introducing it and some measures can be taken to be perfect.
