Although a expression of “Public Interest Litigation” had been appeared at Classicaltimes, the expression was given by Abram Zeiss, the professor of Harvard, in modernmeaning. Public interest litigation in China is defined broadly to include a judicial process,normally in relation to social and economic rights, are litigated in pursuit of legal remediesagainst government departments, public authorities, and monopoly enterprises. And publicinterest litigation of consumer is defined that someone who has the right given by law canbring a lawsuit against the trespasser whose harmful action brought injured to someconsumers.Since2013, The Civil Action has already changed. The55thof this action ruled that thebehaviors which harm to environment and rights of consumers can be sued by governmentdepartments or some organization decided by law to protect public interest. The Civil Actionis also intended to provide simple, speedy and inexpensive redressal to the consumers’grievances, and relief of a specific nature and award of compensation wherever appropriateto the consumer. The main objective of this paper is to ensure the better protection ofconsumers.This paper discusses the definition of the public interest litigation and the public interestlitigation of consumer as the basic theory for the full text of this chapter. The paper not onlyincludes evaluating foreign law and the Taiwan law, so that they can give some advices for us,but discusses about the public interest of consumer law and juridical practice of our country.The most important of this paper is to probe into disadvantages about the procedure of publicinterest litigation of consumer, and the paper will give some comment and proposal on thepublic interest of consumer law of our country.The public interest litigation of consumer is a big advantage of our lawmaking and ourlaw system. The legislation is not only in favour of protecting rights of consumers, but alsoregulating the action of operators. And the most important value of this legislation is to educate people who take part in the public interest lawsuit of consumer and to construct amore harmonious society.
