Every individual in a society is endowed with human rights and a civilizedsociety or the state should provide necessary safeguards for individuals to upholdhuman rights, which reflects the development and progress of a society or a country.A society or a country should draft sound laws and regulation, providing a strongsupport system to protect human rights, in particular for vulnerable groups, forwhom the special protection measures should be layed down. The thought ofprotecting human rights was written down in The Constition in2004, and thegoverment has attached great importance to the cause of protecting humanrights,which has beening upgraded and improved continuously. The mental disorders,who are members of society, are endowed with natural and social attributes and theirhuman rights should not be ignored,they should not be discriminated and persecuted,they possess human rights and their life and dignity should be respected.Suffering mental illnesses begets special physiological and psychological states,having an extremely negative impact on the living environment and the social status,which constitutes a serious threat to human rights. However the patient,as membersof society, should has basic human rights and should be respected and protected,which suggests the progress and civilization of a society and reflects ethical and moralrequirements. The survival state of mental disorders in the real world are worrying,their basic human rights is undremined because of lacking rules and law and beingshort of nomocracy.The law of protecting human rights isn’t sound in China, theimplement of enforcement and supervising is weak and there are misunderstandingsand prejudices to mental illness and mental disorders from the public,which lead toan ill effect on protection.Defending human rights of mental disorders is the core of the thesis and thesound legal protection system of human rights for them should be established. Theconditions of protecting their human rights as a whole is poor, whose rights of the life and the health are often at risk and infringed, it is difficult for them to defend theirpersonal and property interests and there is a strong discrimination from the public tothem.The welfare for mental disorders shoule be enhanced, their living enviromentshoule be improved, they are encouraged to integrate into the community,the systemof guardianship and identification is reformed and ameliorated,the responsibility ofthe goverment is strengthened, the model of community-based health care is reformedstep by step.The level of welfare protection for mental disorders and their families isupgrated and their interests shoule be defended to the maximum. |
