After being introduced into the utility sector, in a certain period of time and to a certainextent, franchise model solves the previous drawbacks of the nationalization of utilities by usingits unique advantages. But the monopolistic conduct of utilities franchise has becomeincreasingly harmful because of the history and specificity of China’s administrative system. Itnot only damages the interests of the people as consumers, but also poses a threat to the orderlycompetition of China’s market economy. I hope that through the in-depth study of the monopolybehavior and legal regulation in utilities franchise, this thesis will provide reference to promotethe development of the theory of law and the perfection of the legislation in this field. Thisthesis is divided into3parts.The first part is the monopoly and problems of the franchise. At first, this part talks aboutthe public utilities by introducing definition of the utility business model and cause of themonopoly in Utilities franchise. On one hand, it can facilitate a clearer understanding of thespecial features in utilities franchise, on the other hand, it can also provide a theoretical basis forthe analysis of utilities franchise monopoly. Secondly, it analyses the monopoly and influenceof the franchise in order to illustrate that the Utilities franchise’s monopolistic conduct shouldarouse our dual emphasis on the aspects of theory and practice.The second part is reference about anti-trust legislation of foreign Utilities franchise. Thispart gives a detailed description of specific practices and laws about antitrust aspect in thesetypical four countries such as United Kingdom, the United States, Japan, Germany. In order toimprove regulation of the Utilities franchise monopoly, the author learns rationally bycomparing, summarizing and combining with the situation of our country.The third part is about institutional arrangements of anti-monopoly in Utilities franchise.This part firstly introduces the current situation of legislation and problems of utilities franchisemonopoly. Secondly, it makes a systematic idea about anti-monopoly in Public Utilities inChina franchise through3aspects such as market access system, price mechanism and legalregulation in government regulatory.In the concluding part, the author pointed out that there are still significant gaps in the legalregulation of Utilities franchise monopoly behavior. Utilities franchise enterprises damage theinterests of consumers and other operators because of abuse of market superiority. So, theauthor suggests China should pay attention to this problem. China should build a sound legal system and form an effective mechanism of competition and good oversight mechanisms. Itwill protect the interest of the public and maintain the healthy development of the marketeconomy.
