Some Problems Of Major Accident

In recent years, negligence accidents Occur frequently in our county, the safetyproduct of mines and enterprises are specially severely.There are not only natural and social causes, but also have their legal cause forthe frequent accients. in order to combat and curb the liability accident crimes moreeffectively, the government has published 《The Amendment to the Criminal Law ofthe People’s Republic of China (VI)》at2009，it perfected the Negligently CausingSerious Accident Crime，though it happens that law has shortcomings with thedevelopment of information technology, science and society, especially the complexand multifactorial characteristic of new negligence accidents. This article proceedswith criminal forms, consequential offense and supervise negligences views to offeran overall consideration, in order to perfect the crime of major accident legislation, torealize the suitable using of laws, to bring safety production to employees’ andemployers’ attention, to keep down the crime of major accident by the weapon of lawand to safeguard the economic construction go on wheels.This article is divided into three parts. The first part is the bedding part based ontheories, expounding the causality among professional negligences, supervisenegligences and non-action crime and dangerous negligences theories. The secondpart is the analysis against the weakness and shortages of the crime of major accident,and raise questions about that. The third part is to analyse the two parts above andoffer a perfecting suggestion.
