Rural Land Contracting Right Legal Issues

Since the reform and opening up, China’s various undertakings flourish, thismakes the city the process of Urbanization, but the pace of economic development inrural areas is far behind the city, the urban-rural gap is widening. Over the years, theCPC Central Committee and the State Council in order to overcome the manyobstacles in the development of agriculture,the development of China’s agriculturalimplemented many favorable measures, such as the agricultural tax relief、increasingdirect subsidies to grain、increasing investment in rural infrastructure construction、increasing technology services to farmers planting etc. Such measures to promote thedevelopment of agriculture in our country and help farmers increase income, tofurther improve the standard of living. But in recent years, with a large number ofmigrant farmers, rural labor force sharply, the government realized that if we wnatto increase the development of rural economy furtherly,we must change ourtraditional planting mode which is local small-scale peasant farming,and wu mustimplement large-scale production of agriculture,making the labor force out from theland. And rural land contract and management rights transfer is the premise oflarge-scale agricultural production, only land resources for re-integration, theformation of large-scale into a piece of cropping patterns, then add the mechanizationof production, can improve the efficiency of agricultural production greatly, whichled to the development of rural economy, really help to farmers. Transfer of rural landcontract and management rights in practice is not without obstacles, so far, thecirculation of rural land contract and management rights there have been a series ofproblems.In view of the development situation, based on Chinese rural land contract andmanagement rights circulation system as the object of this study,through summarizedthe issues related to China’s rural land contract management rights transfer, and thenfrom a legal point of view about the cause analysis, and then proposed solutionsand legal systems design, this article aims to achieve the smooth transfer process of rural land contract and management rights, and to achieve the fullest protection of thelegitimate rights and interests of farmers in this process,I hope from a legal point ofview to explore the land transfer mode for China’s rural development, so as to help thedevelopment of China’s rural economy.
