Research On The Policy And Legal System Of Financial Company Business Supervision In Our Country

China’s financial companies have thrived to be emerging forces promoting thefinancial reform and innovation during the past twenty-five years. As they are now facinga new business period as well as a more comprehensive and in-depth financial reform,more attentions and researches on financial companies are necessary.Business supervision system in the financial company is a key factor to guide andpromote the company in its growth. This thesis takes the carriers of these systems, namelylaws, regulations, rules and police documents adopted by the supervision department tosupervise the company’s business as the research object. In addition, the "policy" is alsocovered in the research due to the popularity of "policy overwhelming law" in thefinancial company supervision field.The first part of this thesis defines and overviews the financial company and itsbusiness regulation and also reviews their development at various times. The second partanalyzes the current business supervision policies of the financial companies and the legalsystem. This part states three problems namely the leg behind, the conflict and the gap ofthe supervision law and policy which exist in the supervision policy and legal system ofChina’s financial companies comprehensively in detail. And at the same, it also exploresthe causes for those problems from guiding ideology, formulate way and content ofbusiness supervision policy and legal system. The third part introduces the supervision ofsome typical foreign countries and discusses the enlightenment taken from them,including their emphasis on the legal status of the function of the company and thecoordination of the supervision as well as the reasonable legislative process. Aim at thecause for the problem, the fourth part puts forward suggestions to improve the supervisionpolicy and legal system. In the aspect of guiding ideology, the supervision departmentshould pay attention to moving towards legal supervision from policy supervision, at the same time,the supervision department should be practical and realistic; In the aspect offormulation and content. The thesis suggests that the legal system of the supervision bodyof the financial company and the legislative process of the industry should be improved,the legal status of the function of the financial company should be set up reasonably,variant supervision policies should be improved and legislative gaps should be filled.
