The issue of food safety is increasingly becoming the focus of attention. Afterfollowing the "melamine-tainted milk powder incident ", the" waste oil "," shoesjelly " and a series of large-scale food safety incidents has beenfound.Compensation system of civil law on food infringement provisions have beenrelatively well, Administrative Law has also made more detailed provisions of theCriminal Code provisions matures. However, large-scale food safety incidents arestill emerging, one after another.Is to be traced: tort damages is limited to the natureof the compensation, the administrative responsibility is difficult to implement, andthe criminal law can only solve the issue of criminal responsibility of personsresponsible for, and so that they can not be due economic sanctions, assume thecorresponding social responsibility. This article innovative food safety in punitivedamages is positioned as a Law Responsibility expand legal thinking on improvingfood safety in punitive damages system in this premise.This article is to start from the definition of punitive damages system to analyzethe current situation and problems of the punitive damages China ’s food safetysystem, and put forward feasible suggestions to address these issues, the punitivedamages system become more perfect system of food safety responsibility for theaccident. The text is divided into three main sections:The first chapter is to write the punitive damages system definition,characteristics, the nature and function of elaborate. This chapter comprehensiveintroduction to the punitive damages system to accurate scientific position in thedomestic and international research and development status and future trends of thesystem of punitive damages. Highlighted its significance to explore the economiclaw.The second chapter around our laws and discuss about the the legislation currentsituation of food safety in punitive damages system and its existing problems. Thischapter details a series of problems that exist in this system. The third chapter is for the problems exist in China ’s food safety punitivedamages regime, according to China’s economic, social rule of law and the statusquo, detail about punitive damages applicable system recommendations are discussedin this chapter.
