China's Food Safety Supervision Mechanism Of Accountability

Food safety is a major problem in the relationship between the beneficial to the people’s livelihood. To ensure the safety of food, for improving the party’s ruling ability and the ruling level, to build a stable and harmonious social order, it is important to establish a responsible government, the government ruled by law and democratic constitutional state. The current food safety problems in China are highlighted, the grim situation, has been on China’s economic development and social stability caused significant interference, the life and health of the people and the government image caused significant harm. Despite the seriousness of the country has been aware of the problem, has taken a series of measures to strengthen supervision, food safety, however, from the actual governance effect, is not ideal, is the food safety problems emerge in an endless stream, despite repeated prohibitions. Why food safety problem is banned repeatedly more than, how to contain the problem of food fundamentally, this is the hot topic of theory research in recent years.The author thinks, cause China’s food safety problem happening is neither in the food safety legislation is not perfect, nor in the defects of food safety supervision system, but in the food safety supervision of the main supervision, law, in the regulatory process, lax enforcement of the law, illegal not study corruption, malfeasance, did not perform their supervisory responsibilities. They dare to openly administrative omission, negligence and corruption, is because our country is currently in the field of food safety has not formed the system of strict and effective system of accountability. Mechanisms for accountability government regulators "Damour Damocles", is to standardize the supervision personnel behavior of the soul. The responsibility if not implemented, not only from the reality to curb supervision dereliction of duty, also do not accord with the powers and responsibilities consistent principle theory. Therefore, this paper focuses on food safety supervision and accountability mechanisms, trying to improve the accountability mechanism as a breakthrough, effectively solve the problems of food safety supervision in china.This paper is divided into four parts, the first part is the introduction of food safety supervision and accountability mechanisms, and from two aspects of theory and practice focuses on the necessity of responsibility investigation mechanism. The second part is the analysis of China’s food safety regulatory responsibility mechanism the present situation, that the main problems existing in China’s food safety supervision and accountability mechanisms are normative responsibility legal provisions are vague, accountability, accountability is not enough and the liability form. The causes of these problems lies in our democratic system is not perfect, the lack of power restriction mechanism, other causes include China’s administrative accountability system lack; food safety supervision of the main division of labor is unknown, unclear responsibilities; supervision of food safety of the main body of the judicial investigation is not in place; the social and public supervision. The third part introduces and summarizes the western developed countries, food safety regulatory responsibility of some experience and enlightenment, provide a useful reference for us. The last part puts forward the specific proposals to improve China’s food safety supervision and accountability mechanisms, including perfecting China’s democratic governance mechanism, strengthen the restriction to the supervision of the main power; improving the food safety legislation, improve the supervision of the administrative accountability mechanisms; optimize the food safety regulatory system, regulatory authority and responsibility clear regulatory body; increase the punishment, strengthen accountability judicial responsibility for food safety regulatory bodies; expanding social participation, improve the supervision of food safety supervision mechanism.
