Since the internet appeared, it penetrated into people’s life in an unprecedented speed and changed people’s life mode. The internet world is free, convenience and openness, these qualities made a new consumption trend of this generation——-various of works’ spread and download in the internet. On one hand, the rapid development of internet digital technology is good for promoting the dissemination of works; on the other hand, it brings severe challenges to the traditional copyright protection. That means, the internet makes people’s life more convenience, at the same time, it also makes many new copyright infringement questions. In the internet, network users infringed the copyright owners’rights in many different kinds of reasons and methods, but the owners are powerless to protect their rights. Among many kinds of internet copyright infringements, the musical works’infringements seems to be the most severance one. Nowadays, online musical works has become the No.l search object of Chinese internet users, they can be easily copied and played in the internet while have no damage to the qualities. This mode of dissemination of musical made a tremendous damage to the right owners who include music creators, performers and music production companies.The dissemination of musical works in the internet has many procedures, for example:copy, download and upload. If internet users use musical works without right owner’s permission, we can say he inviolate owner’s information dissemination right. In the internet, single person is the user, the internet service provider is spreader, and both of them are mainly subject in the infringement. The users, internet service provides and copyright owners made a tripartite sphere of interest of the online music market.In China, the legal protection of online musical works is far behind the needs of the internet’s development. Musical works’ protection should be combined the related legislation of foreign countries with present situation of domestic network transmission right protection, adjust the traditional music copyright protection system, deal with various of network environment torts, resolve the problem of network transmission right infringement of musical works, balance the interests among copyright owners, spreader and online users.
