The South China Sea (SCS) is one of epicontinental sea of China. It got its namedue to the fact that the sea is to south of China’s mainland. The SCS is surrounded byChina Taiwan, the Philippines, Brunei, Malaysia, Vietnam and China. With richfisheries resources and various aquatic species, the area is a natural fishing ground.Since the1960’s, tension grew in this area while sovereignty disputes emerged. Thefishery disputes in turns started to expand and escalate. In recent years, incidents suchas Chinese fishermen being chased or detained by foreign authorities, and conflictsbetween Chinese fishermen and fishermen from other countries frequently happened.For the sake of sustainable development of fishery in the SCS, surrounding courtiershave conducted some co-operations and communications relating to fishery. Someeven established bilateral and multilateral co-operation mechanisms. However, theexisting fishery co-operation mechanisms failed to solve all contradictions anddisputes in fishery production and development, due to flaws in various aspects.Norway and Iceland successfully resolved the fishery dispute in the adjacentwaters of the Jan Mayen Island by reaching a joint development agreement andestablished some co-operation mechanisms, which has served as a model of politicalapproach of international fishery disputes. This paper analyzes the process ofresolving fishery dispute in adjacent waters of the Jan Mayen Island, and comparessimilarities and differences between it and international fishery disputes in the SCS.Finally, it draws conclusions by offering a possible approach solving internationalfishery disputes in the SCS. That is suspending Sovereignty disputes about islandsand waters, consulting with the principles of equality and mutual benefit, establishinga government organization similar with a mediation committee to promotesurrounding courtiers to reach fishery agreements and achieving the fisheryco-operation in the SCS finally.
