Analysis Of Current Situation And Influencing Factors Of Rights Protection For Migrant Workers With Work-related Disability

With constant development and perfection of social security system, as well as the successive issuance of a series of laws and regulations, such as Labor Law, Law on Prevention and Control of Occupational Disease, Regulation on Work-related Injury Insurance and Measures for Identifying Work-related Injuries, it provides various guarantees for the rights protection of migrant workers with work-related disability. Under such a background, what kind of process will migrant workers with work-related disability go through for the rights protection, what kind of characteristics, what kind of problems are there, what are the underlying reasons? All these questions have important theoretical significance, as well as outstanding practical value, which are worth further studying.Therefore, long-term field investigation has been conducted for the individual case of Shandong XX construction engineering group with the field dynamic theory of Kurt Lewin as the guidance, and rich first-hand materials have been achieved with in-depth interview, aiming to analyze the current situation of rights protection and major causes of the current situation for migrant workers with work-related disability in China. According to the study, migrant workers with work-related disability are characterized by’insufficient knowledge of rights protection’,’insufficient confidence in rights protection’and’extreme rights protection’. It has been discovered after further analysis, current situation of rights protection of migrant workers with work-related disability mainly results from the interaction of personage (P) and environment (E). Personage factors are mainly reflected by the loss of cultural capital, self-abasement, marginalization of roles, weak organizational ability and low economic income, which mainly result in the weak position; while the environmental factors mainly include requirements on the rights protection procedure and high cost, lack of responsibility in local government, illegal operations of enterprise, weak social strength, etc. Furthermore, the individual factors and environmental factors will influence and restrict each other.The contribution of this research mainly lies in its theoretical support, namely the filed dynamic theory. As a result, the individual factors and environmental factors behind the current situation of rights protection of migrant workers with work-related disability are explored, and furthermore, interactive influence of the two is further explored. Of course, this study is only a case study based on Shandong XX construction engineering group, and its representativeness and comprehensiveness are limited. However, according to the author, it lays a foundation for profound further studies in the future.
