The Research On Sports Brokers’ Violations Of Fiduciary Responsibility

Although there have been lots of researches about sports brokers at home andabroad, the system related to liability for sports brokers’ violations of fiduciaryresponsibility is not enough mature and perfect, as sports agents starts late in China.So it is necessary for furthur research both theoratically and practically. Especially inrecent years the sports brokers’ action of violations of fiduciary responsibility has tosome extent hindered the healthy and orderly development of the sports brokerage, somore and more scholars and lawmakers begin to pay attention to this problem. Chinahas established rules to restrain sports agents’ behavior, but there is a big gap for therules to meet the requirements of the theories, so related issues are worthy of our in-depth study, such as the definition of sports brokers’ violations of fiduciaryresponsibility, their accountability, type, the imputation principle and specific scopeof sports brokers’ violations of fiduciary responsibility. How to accurately definesports brokers’ violations of fiduciary responsibility is the important precondition forthe deep research in breach of ifduciary duty. According to both domestic and foreignscholars’ point of view, China’s sports agents’ breach of fiduciary duties can bedefined as the violation of statutory or contractual obligation, which infringes others’lawful rights and causes losses to them and as a result the violaters shall bear civilliability. In order to better prevent such actions of sports agents, it is necessary toclear sports agents’ responsibility for his breach of ifduciary responsibility, and givespecific analysis combined with related typical cases. With the enlargement of thesports brokerage market and the diversification of breach of fiduciary duties, type ofsports agents’ breach of ifduciary duties and imputation principle have graduallybecome the focus of the research’. Chinas peculiar development background andenvironment of sports agents made it rather complicated to determine the specificscope of sports agents’ breach of fiduciary duties. So the damage caused by sportsagents’ breach of ifduciary duties should be analyzed from legal aspect as well ascontractual aspect based on existing results theories andachievements.
