The Legal Supervision Of Community In The City Of Foshan Guangdong Province

The thesis is under the background of the reform of "strong town with simplifiedpolicies" in Guangdong. With the operating mode and the practical situation in thecommunity prosecutorial department of the procuratorial organ in Foshan since2008as the research object, combined with the history of development, the functions andthe limitations of the community prosecutorial department, the thesis analyzed deeplyabout the necessity and the feasibility of structuring the working mechanism of legalsupervision in community. By comparison with other working mode of legalsupervision in community in other districts of our country, it raises the overallapproach to structure the legal supervision system in community with synthesizing theadvantages and the disadvantages of various modes.The thesis is made of five parts.The first part discusses the purpose and the importance of the survey: firstly, itintroduces the background of the reform of "strong town with simplified policies";secondly, it shows the expectation of achieving the goal of promoting the communitylegal supervision system in our country by investigations; thirdly, it discusses thetheoretical significance and practical value of the thesis again.This paper in the samefield theory research belongs to initiate, fill our country about the community legalsupervision mechanism research gaps; the construction and Countermeasures topromote China’s community legal supervision mechanism establishment and theconsummation, and Foshan City, the procuratorial organ ’s community legalsupervision in the existing mechanism belongs to the procuratorial system in reform,do not need to break through the existing laws and regulations, has the very strongpractical value of popularization.The second part discusses the methods and the object of the survey: The thesisuses the method of comparative analysis, historical analysis, and empirical analysis.And the object of the survey is the working thought, mechanism construct, the actualoperating mode and the effectiveness of the operation of the community prosecutorial department, which is set up creatively in33primary-level organizations such asLecong town in Shunde district by Foshan procuratorate since2008.The third part discusses the consequence of the survey in detail: at first itintroduces the background of developing the legal supervision in the communityprosecutorial department of the procuratorial organ in Foshan; and then it sorts thestaff management, job duties, job effectiveness and the main problems existed in thecommunity prosecutorial department since2008.The fourth part analysis and discuss: it puts emphasis on the necessity andfeasibility of structuring the community legal supervision system, combines with thehistory of the community prosecutorial work in our country, analyzes two of the mostimportant modes of the outpost tribunal of procuratorate in our country comparatively,and it gets the conclusion that the community legal supervision system is especiallysuitable for China’s national conditions.The fifth part the conclusion and the suggestions: it puts that the establishment ofthe community outpost tribunal of procuratorate should follow the principles ofsetting up correspondingly, working independently and management by objectives,and the name should be unified as the prosecutorial department, the set of theorganization should be "the stereo secondary structure", and the function orientationshould put the reinforcement of the legal supervision as the basis, and put the servicegroup as the carrier.
