The Research On The Improvement Of Chinese Government Administrative Regulation

As an important part of government regulation administrative regulation is the regulatory to the agencies and their personnel which predominate economic regulation and social regulation powers, that is regulation by regulation. Needless to say, the administrative regulation has a very important significance to reduce regulatory failure and improve government regulation performance. With the constant improvement of China’s socialist market economic system, the basic role of the market in the allocation of resources has been consolidated. However, market failures occur frequently due to the inherent defects of the market economy. Government regulation as an important means to correct market failures, the importance of it has become increasingly prominent. But, government regulation is not a panacea. Due to the lack of regulation by regulation, namely the lack of administrative regulation which makes the serious malfunction of government regulation. So, in order to enhance the efficiency of government regulation and improve performance resource allocation, there is much need to strengthen the administrative rules and regulations. At this stage, due to the unsound of China’s socialist market economic system, the hysteresis of Political system and the Administrative system, plus the lagging construction of relevant laws and regulations.There are many drawbacks of administrative rules and regulations. It includes four aspects:first, the lack of independence, absence of administrative regulatory agencies; second, the unsound of administrative rules and regulations related system; third, the coexistence of administrative regulations excessive and administrative regulations insufficient; fourth,the other administrative regulatory body which outside the government is unable to unleash its own function. Therefore, we should be based on the basic national conditions of the country, then learn from the advanced experience of the reform of government regulation in the Western countries and promote the reform of the administrative rules and regulations vigorously, in order to improve the administrative regulation system of our country. I believe that, we must adhere to the principle of regulatory evidence, public interest, transparency and public participation, balanced so that can improve the administrative rules and regulations of the Chinese government. At the same time,we must accomplish following aspects: first, the establishment of an unified, authoritative, independent administrative regulatory agencies; second, the improvement of administrative regulation laws and regulations; third, strengthen related system of administrative regulation; four, perspicuity the main responsibilities of various administrative regulation.
