Research On Overseas Intellectual Property Disputes And Countermeasures Of Chinese Enterprises

With the advent of the era of knowledge economy,intellectual property rights isbecoming the strategic resource of national development and the core element ofinternational competiveness.And in the new century, intellectual property rights hasbecome one of the world’s top three trade which are trade in intellectual propertyrights,trade in goods and trade in services.With the process of economicglobalization,countries expand competition increasingly fierce around intellectualproperty rights. Intellectual property disputes are increasing, and has gone beyondborders,and become a hot issue of international trade friction. Chinese economy is ina transition period,China’s enterprises suffers intellectual property disputes overseasfrequently for various reasons,and getting worse.The increasing Intellectual propertydisputes has brought serious economic losses to Chinese enterprises and affected theimage of corporates and country.Effectively respond to overseas intellectual propertydisputes and resolve them related to the future development of Chinese enterprisesand the improvement of China’s foreign trade relationship,which has become animportant problem that China’s export enterprises need to focus on.This paper focuses on the hot issue of overseas the intellectual property disputesthat Chinese enterprises face,based on the international trade protection theory,gamethroey,production capacity conflict theory and political economics of nationalintertest first and hegemonic stability theory. Then starts from case analysis,the paperfocuses on analysis of the current situation of overseas intellectual property disputesthat Chinese enterprises suffered,including the situation of the overseas developmentof Chinese companies and the status of Chines enterprises overseas intellectualproperty disputes in number growth and sector breakdown, summarizes the mainfeatures of overseas intellectual property disputes those are rights difficult,obviousregional chacteristic and prominent political overtones.On this basis, the paperanalyzes and summarizes the main issues of Chines enterprises overseas intellectualproperty disputes and analyzes the reasons of frequently overseas intellectual propertydisputes comprehensively and profoundly based on govement perspective andenterprise perspective.The last,on the basis of previous analysis,and combined withinternational business practices, put forward rational proposals for China ’s corporatesto response to overseas intellectual property disputes from government perspective and enterprise perspctive,but it focus on micro-level based on enterprises.
