Drug crime harms the society to a great degree and it is the key target for the government tostrike. The trend of the current drug case is the increasing number of drugs, behavior is gettingmore and more covert, drug-related personnel anti-detection means are more and more strong. Itbrings certain difficulties to public security organs to capture of criminals and collect evidence.Some problems exists in the captured and prosecution of drug cases, such as there may also becharged, volume, unfinished form of crime, legal facts, evidence collection, analysis and adoption,legal understanding and application of judicial problems.This paper, by means of the case of Zhang and Hou smuggling, trafficking in and thetransport of drugs, analyzes in the form of the drug crime in judicial practice and the problemsencountered in the review, analysis of the controversial crime cognizance, amount of the drug,purity identification, common crime master make identified issues and related law, at the sametime discuss on the drug crime case evidence problems.This whole paper has been departed into three parts,18000words approximately.The first part is about the basic case and the focus of controversy. It brings the introductionto Zhang and Hou’s case and the process of the judgment while sorting out the focus ofcontroversy in this case.The second part analyzes the criminal law issues. Combining with the case of dispute, itanalyzes in the following aspects: the affirmance of drug-related behavior and the principal andaccessory in cognizance, drug quantity and purity identification, drugs transport attempteddetermination and the application of the death penalty.The third part is approaching on the subject of the evidence of drug-related crime. It ismainly exploring on the problems and difficulties of collecting evidence during the stage ofinvestigation, and also the problems on the stages of a trial evidence cognizance and applicationtheoretically and practically.
