In the field oforgan allocation, no specific organ receiving, distribution, the rating agencies, which leadsto low utilization of organs and other phenomena have occurred.This article tries from the living organ transplantation in Human Organ TransplantOrdinance as a starting point to explore the legality of living organ transplantation andcontrast abroad to give us a recommendations.Thesis has five chapters. the first chapter a review of the basic problems of organtransplants basic concepts, classification and development process of organ transplant; thesecond chapter discuss the legality of actions of the donor, recipient, and medicalinstitutions, come to live organ transplant legislation the legal basis; the third part is usedto focus on the foreign organ transplants analysis of legislation, put forward the referentialsignificance legislative organ transplantation in China; the fourth part is used to recall theprocess of China’s organ transplant legislation, pointing out the deficiencies in the currentOrdinance; the fifth part is used to the basis of foregoing theoretical analysis, put forward ideas and proposals to build and improve the legislative, judicial, and organ systems ofliving organ transplantation.
