Human living organ transplantation is the brightest jewel in the history of medicine.So far it has saved the lives of many patients with organ failure. The progress of scienceand technology is not just technically, but it also impact on human social system, organtransplantation is no exception. While the benefit of mankind, but also to the existing lawsto bring a challenge; promoting human from the new thinking about the value of life andthe social order. The direct consequences of the organ transplant States enacted the organtransplant law to adapt to their own national conditions.Development of organ transplants has a significant own characteristics in China. Onthe technical side, although we started late, but the fast pace of development, andbecoming the second largest after the United States organ transplant center. On thelegislative front, China’s organ transplantation has later legislative consciousness. Untilthe2007introduction of the Human Organ Transplant Ordinance to get rid of an organtransplant country does not have the embarrassment of the national legislation, which isobviously organ transplantation in china as a large country is not consistent. In the field oforgan allocation, no specific organ receiving, distribution, the rating agencies, which leadsto low utilization of organs and other phenomena have occurred.This article tries from the living organ transplantation in Human Organ TransplantOrdinance as a starting point to explore the legality of living organ transplantation andcontrast abroad to give us a recommendations.Thesis has five chapters. the first chapter a review of the basic problems of organtransplants basic concepts, classification and development process of organ transplant; thesecond chapter discuss the legality of actions of the donor, recipient, and medicalinstitutions, come to live organ transplant legislation the legal basis; the third part is usedto focus on the foreign organ transplants analysis of legislation, put forward the referentialsignificance legislative organ transplantation in China; the fourth part is used to recall theprocess of China’s organ transplant legislation, pointing out the deficiencies in the currentOrdinance; the fifth part is used to the basis of foregoing theoretical analysis, put forward ideas and proposals to build and improve the legislative, judicial, and organ systems ofliving organ transplantation.
