Since the reform and opening up, with the rapid and stable growth of marketeconomy, China is transforming from a traditional agricultural society to a modernindustrial society. The whole Countries vigorously promote urbanization in rural areasin recent years. This makes rural society has undergone great changes in the political,economic, cultural and other aspects. In such a period of change, Market-oriented drivespeople to gradually utilitarian. The diversity of interests makes rural disputesmorphogenesis corresponding changes. Compared with the previous, disputes reflectsthe different characteristics in the number, type, and content of the square.China since ancient times, is a large agricultural country. Farmers accounted for themajority of our population, in order to ensure social stability and development; we needto maintain the interests of farmers firstly.Traditional country--dispute resolutionmechanism can not meet the needs under the new situation. The current rural had notbeen "society of acquaintances" described by Mr. Fey, and still not a "civil society". Weshould take into account of these unique circumstances when build up a new disputeresolution mechanism. Alternative Dispute Resolution can be applied to disputesettlement mechanism according to the actual situation of the countryside. We shouldhave a full understanding of contemporary "change of rural” so that we can give fullplay to the role of National Judicial. These two approaches are not mutually exclusive;we need to bring the two modes together in order to have the maximum effectivenessfor protecting the interests of farmers. Article goes on this idea, at the first part of article,we analyze the characteristics of the disputes.The second part focuses on the disputeand dispute settlement mechanism existing in rural areas.We then pointed out theshortcomings of the dispute settlement mechanism. In the final part, we emphasized theneed to combine the two modes to fully safeguard the interests of farmers.
