Research On Judicial Proposal System

Judicial proposal is the extension of court adjudication, which playsa significant role in social administration and the construction ofharmonious society. However, the operation of judicial proposal systemis still under graduate improvement.This paper aims at putting forward some approaches of improvingthe judicial proposal system on the solid basis of profound investigationof the status quo of judicial proposal system in Shanghai Court Institutionand the careful analysis of the problems incurring from the investigation.There are four parts in this paper:The first part focuses on the fundamental concepts of judicialproposal, including the definition, classification, legal basis and the legaleffects of judicial proposal.In the second part, the values and functions of judicial proposal areillustrated. That is to say, judicial proposals are the extension of court adjudication, approaches of social administration, helpful to theenhancement of judicial authority and to the social harmony.In the third part, the paper pays great attention to the investigation ofthe status quo of judicial proposal system in Shanghai court institutionand makes careful and profound analysis of the problems incurring fromthe above investigation.In the last part, the paper puts forward four suggestions on how toimprove the judicial proposal system. For example, to make relevant newlaws, to supplement the corresponding operation institutions, to improvethe contents of judicial proposals, and to help build a public socialadministration pattern.
