The Legal Regulation Of Global Navigation System

Global navigation satellite system has developed rapidly in recent years, and has been widely used in military and non-military fields, it is important for national security and social development. With the scope of application of navigation systems and its services are becoming more widely, some complex international law issues have raised, such as sovereignty and security, national equality and navigation services provide liability issues have gradually emerged, and attracted the world’s attention.In this paper, using the current international space law and other legal documents which regulate satellite navigation activities, as well as the main satellite navigation services for satellite navigation activities of domestic legislation, and draw lessons from the related research results, international law problem attempts through the analysis of satellite navigation services generated, combined with the nature of satellite navigation activities, and then analyzed the necessity of the establishment of a unified legal framework under international law as well as possible legislative path. On this basis, combined with the status of the development of our country’s satellite navigation, provide advice, for relevant legislation to be, to develop in line with the needs of China’s navigation system development, in line with the international trend of the relevant legal documents, in order to ensure the smooth development of China’s "second generation of navigation system of Campus satellite navigation" and industry.Based on the comprehensive utilization of inductive method and normative analysis method, providing the relevant domestic laws were sorted and analyzed for the existing global satellite navigation activities in the international legal documents and the main satellite navigation service, tries to illustrate the problem as follows:(1) the global satellite navigation activities is the development and utilization of an outer space activities because of its own, but is different from other outer space activities, there is a need for specialized legislation it;(2) it is difficult to build the framework of satellite navigation system, but it can be reached by improve the regulation of international law on satellite navigation system;(3)for our legislation of satellite navigation activities, can use the mode of Russia, and not violate the relevant treaties, closely combined with national conditions, scientific legislation.
