On Spouse Right

Since the implementation of reform and opening policy up30years, economy hasdeveloped rapidly and social ideology has changed a lot.The old original value hasdisintegrated gradually without the formation of new values,so all kinds of valuesemerge at the same time.Because of that, people’s ethics, life style and family valueshave changed very much.Phenomenon of violating the rights of spouse are increasingly outstanding. Whichseriously impact the monogamy and harmony of family relations. Lots ofdisintegration of marriages has led to some problems, such as teenage viciousness andviolence, which has impeded the development of harmonious society.One of the most important reasons for the phenomenon that more and more peopleviolate spouse right is that our legislation has not clearly set spouse rights andcorresponding remedy mechanism.So that the sufferers is hard to defend their spousesright with law,and indulge in violations of spouse right. So far, our marriage law hasbeen enacted for10years, in which three judicial interpretations have been enacted insuccession, but we have no clear legal provisions of the spouse rights system,which isnot good to protect spouse right.So I Study the history of spouse rights and the currentsituation of China and other foreign legislation, clarify the reality of spouse rights lawlegislation in China, and then gave some suggestions to improve our legal spouseright.
