With the prosperity of service industry, prepaid consumption develops rapidly asa new model of consumption, which is mainly applied to shopping mall anddepartment stores as well as internet shopping, hairdressing, beauty salons, restaurantsand fitness clubs. Prepaid consumption means the customers prepay a certain sum ofmoney for the agreed service at a discount in future. For enterprisers, it can not onlykeep customers but also and recover funds quickly. For customers, it is convenient totake with and brings discount. It is a win-win consumption model. But there are a lotof problems for the immature market condition and related vulnerable legislation suchas the enterpriser’s bully protocols limiting the customer’s rights, the disagreementbetween the enterpriser’s promise and the practical service damaging the expectingreasonable profits, the abrupt close-up fleeing with customers’ money and theexposure of personal information. To solve these problems, the present thesis beginswith cases to analyze the current situation of prepaid consumption card in our country,using the authorized study data to state the customers’ rights in prepaid consumptioncard use. Then it points out the actual defects and the reasons that cause them inprepaid consumption card by analyzing the current situation. Next it introduces someprepaid consumption laws in developed countries such as America and Japan tocompare the legislation situation home and abroad. Finally, on the point of presentnational development of prepaid consumption, it analyzes the structure system ofcustomers’ rights in the field of prepaid consumption and offers the advice of thepublicity system of enterprises’ information, the position succeeded system and thecredibility system to improve the prepaid consumption card market from the angle offinance combined with the useful experience and the updated legislation home andabroad and enhance the ability of Consumer Protection Association, which is using athird force to protect customers legal rights. It finds an effective way to protectcustomers’ rights by the reference of excellent system structure national andinternational including Taiwan and Hong Kong.
