With the development of economy, Industry and finance are integrating more andmore closely. Without the support of finance, it will be difficult to achieve the rapiddevelopment of the industry. And without the support of industry, finance will alsolose its carrier. Industry Investment Funds is an innovative form combined withindustry and finance, which is produced in the industrial growth process and aimed atpromoting industrial and economic development. As an important source ofinvestment in the global market, China’s Industry Investment Fund has developedrapidly in recent years, which plays an important role in promoting the economicdevelopment. However, China’s Industry Investment Fund started under thecircumstances of undeveloped legal system and disintegrated legal regulations. Theexisting certain legal regime has constituted the hindrance for our country industryinvestment fund’s further development. Therefore, further improving the legal systemrelevant to China’s Industry Investment fund with certain depth is very important tohelp our Industry Investment Fund develop healthily.This paper starts with the basic theory of Industrial Investment Funds, Analyzingits basic definition and characteristics and types included. Then, it makes an analysisof characteristics in the development of the local Industry Investment Fund and thelegal obstacles. In the end, the writer puts forward with some suggestions forreference through summarizing the successful experience of the legal systems inBritain, the United States and other developed countries, contacting the actualsituation in China.This paper is divided into five parts:The first section is the introduction. It introduces the background andsignificance of the topic and describes the methods of research and the innovation of this paper.The second section describes theoretical background relevant to the IndustryInvestment Fund. Through elaborating how the concept deduced in China and tellingthe differences between Industry Investment Fund and similar concepts, it determinesthe subject of this article. Then, it makes a more systematic elaboration on thecharacteristic and types of Industry Investment Fund, which helps building thefoundation with the elaboration behind.The third section introduces the practice development and legal status of China’sIndustry Investment Fund. First part of this chapter focuses on describing the overallsituation of the development of China’s Industry Investment Funds, Including thehistory and status quo. Then, it points out the major problems in the practicedevelopment. The rest part focuses on the analysis of the present legislative relevantto China’s Industry Investment Fund, and points out the major legal issues facing thedevelopment of Industry Investment Fund.The fourth section makes a comparative study of foreign-related systems. Thischapter summarizes the development process and funds legislation of the overallsituation of developed countries, such as Britain, the United States. Then it makes ananalysis of successful experiences in foreign-related legislation relating to the thirdchapter, which tells legal barrier existing in our country. It is a very importantreference to perfect the legal system of China’s Industry Investment Fund.The last section puts forward with some legislative proposals to China’s IndustryInvestment Fund. In this section, the author has first introduced from the overseassuccessful legislation experience, and simultaneously analyzing the Chinese actualproblems. On which, the author has proposed his own opinions of the ChineseIndustry Investment Fund legislation pattern. Moreover, this paper also hasconstructed the preliminary tentative plan to the Chinese Industry Investment Fundconcrete system, such as market access mechanism, tax preference and other aspects.
