With China’s accession to the WTO in eleventh years, China’s opening to the outside world further improved, thus green barriers once again aroused widespread concern. Green barrier through the environmental protection standard of strict has certain positive role to protect environment and human health, but also formed a hindrance in some developing countries, barriers to entry, hindering the liberalization of international trade. As a form of international trade protectionism, the green barriers in the meantime plays an important role for the people, but the green barrier for the developing countries are still not fair. As a developing country, we, green barriers will have a profound impact on China’s foreign trade and environmental protection. The legal research on green barriers as the theme, to explore in-depth legal green trade barriers on sound. This paper begins from the analysis of the green barrier concept, characteristics, manifestation, cause analysis and green barriers produce legal conditions and legal research, tries to illustrate the necessity of perfecting the law to deal with the green barrier; secondly, research on legal status of China’s response to the green barrier of the article and the existing problems. On this basis, from the United States, Japan, the EU green barriers to China’s law, legal aspects of the green barriers of the enlightenment. The article finally proposed the imagination of perfecting the law of green barrier in china. To be sound and perfect environmental standard system and environmental label system in legislation, also requires coordination between government departments. Finally from the legal interrupt seeking radical measures to solve the problem of green barriers.
