In recent years, architectural works infringement cases have occurredin China. The main reason is lack of in-depth discussion study in thisfield. So I intend to use it as the theme of my master’s thesis. Startingfrom the analysis of the legal status of the architectural works, overviewof the infringement of the status quo of China ’s architectural works,then Introduce development of the architectural works on copyright lawprotection system. The last part is about analysing the rule and principleof substantial similarity of architectural works. There are four chaptersexpounding on this issue.The first chapter defines the legal status of the architectural worksand explain the reasons architectural works can be protected by copyrightlaw. The third quarter also introduces the principle of substantialsimilarity.The second chapter outlines the infringement of the status quo ofarchitectural works in China, with some typical examples for details.The thired chapter compare two ways of studying the research onsubstantially similarity in United States and China. Focusing on the United States because United States has a certain degree of particularityrepresentative in terms of protecting of the copyright lawThe last chapter is the most important part in my master’s thesis.At first I outline the rule and principle of substantial similarity ofarchitectural works. In China, architectural works is defines into atotal of three types which are "building or structure","architecturalsketches, architectural plans, construction floor plan "," buildingmodels". I will analysis them one by one.
