Study On The Embezzlement Crime Objective Behavior

At present, study on criminal law crime approaching maturity, can be said that it is difficult to achieve innovation. Therefore, in the view of some scholars, decided to conduct a study on the same charges, in order to have an overall grasp of this type of crime, from whole to local comprehensive analysis and solve and improve coordination of the same category accusation of crime. Here, the author will discuss to this kind of crime is named the crime of misappropriation, including embezzlement, misappropriation of funds and the crime of embezzlement of special goods three charges. This kind of crime is concurrent with one action, namely for embezzlement. This paper will be mainly to the objective behavior of the crime of misappropriation as research object, narrow research scope. Study on the objective behavior of crime of embezzlement, has received the attention of theorists, also created a lot of ideas. But most of the scholars are specific on the objective behavior of the crime, there are few studies of the three types, together, this will be the crime of misappropriating public funds for the center of gravity to discuss the objective behavior of the crime of misappropriation. This article mainly in the following context to study the crime of misappropriation of objective behavior analysis. First introduced the objective behavior of the crime of misappropriation range and three crime performance; and then focus respectively explain three crime exists in the objective behavior that the problems in the crime of misappropriating public funds for the related problems of the crime of misappropriation of funds, and the embezzlement of special goods can refer to the crime of misappropriating public funds objective behavior to identify; finally puts forward legislative suggestions of their expression, and put forward their intended for the misappropriation of public property and the crime of misappropriation of property crime units, as the end of the objective behavior of the crime of misappropriation.
