Since ancient times,good Samaritan is the great spiritual wealth for all human beings.Nowadays,The government attaches promoting people participation to the courageous actions while the legal system for the protection of the Samaritan who work but does not provide a very comprehensive,so that many heroes bloodshed and tears.Which led to everyone away from the Samaritan,Social atmosphere worse more.People’s chronic illness of indifference back to life.This paper argues that,just in moral level to praise them is not enough.Fundamental legal protection for them is the best gift.This paper begin with understanding to the basic concept of the Samaritan,then for its legislation protect,state responsibility,foreign related law,our legislative situation and its shortcoming.At last,author put forward some proposal for all problem,hope for a little help to our theoretical study.The article structure is composed of three parts of the preamble, body and conclusion. So this paper try to research some question for establish and improve the Good Samaritan legislation protection in China. In this paper, the text is divided into three chapters, in the first chapter, author mainly illustrates the Samaritan and its legislation protection related concepts.Rationalize the concept while pointed out the importance of national responsibility concept of the rule of law.Then in the second chapter author points out that The present situation of the current local legislation protection and its disadvantages.In the end, author put forward the idea of a unified national legislation and the some suggestion.Including setting up special protection authority, perfect all kinds of welfare program and repeatedly emphasized the importance of government responsibility. In the conclusion section of the article, author again the importance of the unified legislation and The government responsibility, and urgently looking forward to the national uniform legislation.
