Research On Criminal Regulation Of Food Safety

As an extreme manifestation of an antisocial, criminal has become a malignant tumor in the daily lives of people, preventing food endanger the people’s health and life safety. Solving food safety problems is an urgent requirement of the broad masses of the people, during social management of the thorny issues facing the government. To curb the issue of food safety crimes, we must start from the source and to improve the system and the strict implementation of the regulatory regime of each process, while increasing crackdown on food safety crimes, so as to achieve the effect of treating the symptoms.Accoding to analysis the Food Safety Law and the relevant provisions of the Criminal Law, the food safety cime could be summarized as three types, illegal business of crime, production and operation of crime as well as food safety supervision of crime.In terms of the structure of the Criminal Law, the crime which be placed in the Penal Code Chapter III (destruction of the socialist market economic order) food safety supervision of crime is the key to food safety, crime, such kind of crime includes production and sale not meet safety standards of food production and selling poisonous and harmful food crime.Considering perfect kind of crime legislation to promote China’s criminal law for the protection of food safety and safeguard the interests of nationals, therefore this article focuses on the content of production and operation of crime.The first chapter is an overview of the food safety crimes. Including the concept and the feature of food safety and food safety crime. Based on the status quo in China’s food safety, the author researchs the limitations of the civil law and administrative law for the protection of food safety and the need for analysis of the criminal law protection.The second chapter deals with the regulation of the Criminal Law on Food Safety. First of all from our country criminal law for food safety crime of historical evolution, from the start and development two aspects that our country criminal law about food safety regulations to protect all previous revision; Secondly from concept and to the crime constitution respectively analyzes three charges.Finally it is pointed out that China’s criminal law protection of food safety defects.In the third chapter, it is pointed out that China’s criminal law protection of food safety defects. The fourth chapter discusses how to improve our food safety protection. In the level of the criminal law, we should be transformed into the concept of food security and improve the corresponding articles of law provisions;Moreover, it is required that enhencing applicable food safety crime and the proportion of the right to carry out the criminal liablity in the law enforcement; In the civil and administrative law, we discuss the way how to improve the food recall system and food safety accidents emergency response mechanism and illustrate the system with corresponding criminal responsibility of the problem.
