| Criminal record is the objective record to criminal person made by the stateorgans. Criminal record is an important part of modern social management systemthat on one side, it can help the country to manage and control people who committedcrime ever effectively. On the other side, it can reach the function of self-protectionwhich can keep the innocent from people who committed crime ever. Meanwhile, itcan also give the country a guide to help people who committed crime back to society.What’s more, the proper application of crime record can make great function to thesocial management innovation, the social stability, the society’s harmony. There arethree process modes all over the world: publicity, preservation and elimination.Juveniles are a special group who have defects on both physical andpsychological. The fifth meeting of the11thNational People’s Congress passed thenew Criminal Procedural Code on March14,2012. The preservation of juveniles’crime record is stipulated in article275, which is the first time for our country tomake process modes of crime record in law. The establishment of this system willprotect the juveniles’ privacy, reduce the negative impact of crime record and helpreturn to society.However, the preservation system stipulated in the new Criminal ProceduralCode is a principle and there are many contradictions among the judicialinterpretations which will cause the system cannot be executed well. And thepreservation system is only one part of the whole process mode of crime record. Westill need the publicity system and elimination system to make it perfect. This paper raises relevant suggestions to improve our process mode system ofjuveniles’ crime record based on laws, judicial interpretations, national conditions andforeign experience. |
