| With the computer and the internet technology great development, Internet has been playing more andmore important roles in people’s life. More and more people already have their own digital space on theinternet, in which there are photos, videos, letters, and so on. These materials record people daily life, andall these things mean special for them. Not only because these materials cost people a lot of money andtime, but also they are the memory of people when people are old. Besides, some things of the internetspace are very important materials for business. More and more companies contact with their clients andsupplier through internet. Internet space has their client information, product’s details, and accounts. Allthese are very important information for one company. However, because internet just one rising thingcompared to traditional matters and the large-scale using only happened in these years, the inheritanceproblem of internet virtual property doesn’t cause people and internet company attention. When facing thisrising problem, the legal profession doesn’t take timely steps to protect internet virtual property. Comparedwith the traditional property, the author think the internet virtual property owns characteristic, but the mostremarkable difference is that the internet virtual property is virtual and invisible. However, these are theform difference. The internet virtual property is same with traditional property in value and control.Everyone knows that the internet closes very with people daily life. And the number of people who dealbusiness in internet are countless. The Chinese civil law rules the property is that can give people economicbalance and people could control them. From this, we could know that the internet virtual property belongsto civil law and could be inherited by people. Besides, the author analyse the relationships between theinternet virtual property and the internet account. The biggest innovation of this paper is the conclusionwhich is that the internet virtual property is in the protection of the inheritance law. It also gives the specificmethods in the inheritance law application of the internet virtual property.This article includes four parts except the abstract and the ending word, as fallows:In the1stpart, the author introduce two case caused by the inheritance of the internet virtual propertyfirstly. Then, through the above two case, the author make the problem of the internet virtual property, andanalyse the reasons of the ready problem, which are the deficiency of law and the study, the difficulty to value the internet virtual property. In the last, the author abstracts this article’s focus, which is whether theinternet virtual property is the civil law property.In the2ndpart, the author refines the internet virtual property firstly. Then analyse the law attribute ofthe internet virtual property. Through introduces the different theory, this article gives opinion about the lawattribute of the internet virtual property. This part makes prepare for the3rdpart to discuss the belonging ofthe internet virtual property.In the3rdpart, the author discusses the premise and the conclusion of the inheritance law applicationof the internet virtual property. In this part, the author also introduces the dispute of the scholar and giveshis opinion.In the4thpart, the author mainly relates and analyses the concrete implement methods and suggest inthe inheritance law application. |
