The Constitution To Protect The Health Right

By the development of human society today, health problem cannot be neglected problem in the national economic and social development, harmonious society requires the coordinated economic and social sustainable development, so this is also so for the health requirements. From the point of constitution, health problems, not just individual survival needs to resolve the problem; it is a big problem in the construction of the constitutional system. The right to health as a representative of a health problem in constitutional theory has aroused considerable attention of scholars. How to realize the right to health of citizens and how to protect the right to health of citizens is a great difficult problem in front of us. In our country there is no provision of health rights of citizens in the constitution, this bring some trouble to realize the health of the citizens’right. Therefore it is necessary to stipulate rights of citizens in in the constitution of China.This paper combine protection of the right to health in international and regional protection.The international protection for the right to health, with WHO, The world bank, United Nations and other institutions in the promotion of health right international protection and strong effects, these worthy of domestic reference and learn the achievements for our service. For the protection of the rights to health, because of the lack of the understanding of the right to health, not in place of its protection, our country needs to improve our legal system. This two protection method combined with international human rights law, one hand, we have to improve our legal system. On the other hand, the development of domestic health right let our country to establish China’s own laws. This will eventually merge these two things together; the legislative right to health in China plays a great role in promoting legislation.
