| Our Law of Protecting Custom’s Right has stipulated eight basic rights of custom, the right of compensation is one of the custom’s basic rights. It’s the core of the custom’s rights, and it’s the ultimate protection for the other rights. While in the process of transaction, as custom are at the disadvantage, so their claim is damaged frequently. Our country has set up a set of relatively complete legal system to protect the custom’s claim, the Consumer’s Association built in various provinces and cities is also effort to protect the custom’s claims. But due to lots of causes, the protection to custom’s right of compensation is also not very well. This text will analyse the causes of this current situation, and turn to solve this problem. And the text’s focal point is to analyse the new regulate of the Costume Public Lawsuit and the non-uniform system of Punitive Damages System. |
