Only the problem that whether it constitute discrimination is solved,we can see the essence of the problem, when and only it constitute discrimination, It’snecessary to discuss the types of discrimination, causes and countermeasures of theproblem.It uses method of text empirical research in the article. and do a survey on test files ofthe last civil servant recruitment examination of Zhejiang Province, Guangdong Province,Hunan Province, Sichuan Province, Heilongjiang Province, Qinghai Province, BeijingCity. The specific conditions of the register condition are divided into age, gender, workexperience, education, household registration, conduct, qualifications, then gatherstatistics for each specific requirements of concrete position to obtain the number of jobsin various conditions and the proportion of the total posts. Our country still do not haveeffective system of constitutional review, therefore, this paper adopts review mode thatobjective--means is constitutional or not,that is, first legislative purpose is constitutionalor not; if it is, then the means that realize the purpose is constitutional or not; finally, thereis a causal relationship between legislative purpose and means or not. Then the articleanalyze each class of civil servants recruited with this method, come to the conclusion thatthe qualifications for the setting of certain candidates is discrimination at last. |
