| China’s economy has been increasingly developed since the21st century, but it is accompanied by illegal fund-raising crime which contains a big amount of money and people. Ranging from the south to the north, from local areas to the whole nation, this kind of crime has a crawling effect. The appearing of this kind of crime to the public shows that our judicial body took serious punishment towards illegal fund-raising crime. But the discussion caused by the identifying process of the cases reflects the confliction between the current judicial identification and legal regulations and the theoretical study. Based on a profound analysis on the illegal fund-raising crime cases of some typical areas in the west part of Inner Mongolia, this thesis concentrates on law theory, legislation intention, and the current situation of economic development. It confirms the boundaries between what illegal fund-raising crime is and what is not, this crime and others, and raises some advices to the improvement of the interpretation of legislation and judicature.This thesis is divided into5parts:part1, an introduction to illegal money-collecting crime in accordance with legal regulations; part2, a presentation of the crime-committing situation in Inner Mongolia through separate descriptions of typical cases in the west part of Inner Mongolia; part3, to conclude the problems of judicial identifying process in sense of the judicial identification of money-collecting crime in Inner Mongolia, and to explain the existing problems and arguments of crime-identification in practice from many aspects; part4, to elaborate the boundaries between what is illegal fund-raising crime and what is not, this crime and others through two analysis:a rational analysis on the difficulties of the judicial identification of illegal money-collecting crime, an analysis on each argument through legal support and related theories; part5, to combine theory with practice, perfection of legislation with judicial explanation, and to propose detailed advices to the improvement of related legislation and judicial interpretation. |
