Preliminary Study On Reconstruction Of China’s Administrative Reconsideration Quasi-judicialization

Because of the influence of anti-justice viewpoint to the basic functions of the administrative review system, the implementation of the system turns out to be not good. The study on the quasi-judicialization of administrative reconsideration system can help to make consummation to the system.This paper is probed in three aspects. On the basis of analysis of current anti-judicial orientation of administrative reconsideration system, jurisprudential support to the reform on the quasi-judicialization of administrative reconsideration and evaluation on the solution of the quasi-judicialization administrative reconsideration, and by means of reference to foreign advanced practices, this paper tries to put forth some constructive suggestions and solutions to the reform on the quasi-judicialization of administrative reconsideration.In Conclusion, during the process of accelerating quasi-judicialization of administrative reconsideration, we shall try to perfect the quasi-judicialization of administrative reconsideration system by means of adaption of quasi-judicialization administrative reconsideration viewpoint, assurance of the independence of administrative reconsideration instiution and principle strengthen of administrative reconsideration procedures etc., thus to guarantee the right of the administrative couterpart...
