Study On Redistricting Election Issue System In Our Country

The content of this paper is the redistricting election issue system in our country, consists of three parts. Among them, the first part is the redistricting overview, mainly introduces the redistricting meaning, significance and current situation of China’s redistricting and foreign representative districting system, analyzed on the reference of foreign experience to china. In the second part, the author through combining the current electoral law of redistricting and typical case, analysis of the main problems of insufficient and the practice of the legal provisions of the demarcation of constituencies in the. Because our country is in the redistricting organization, division of standards is not scientific, resulting in practice of arbitrary demarcation of constituencies, but due to the lack of relief channels of effective supervision mechanism and the corresponding laws, problems of illegal redistricting division can not be supervised effectively control, effective legal remedy cannot voters and candidates when their rights are infringed, affect the realization of equal voting right of the constitution. The third part, the author in view of the above problems, puts forward some legal suggestions on improving the redistricting system in china. Include in the redistricting institutions, the establishment of specialized agencies, professional demarcation of constituencies, the temporary at present election committee to take the redistricting function and instability; in order to enhance the scientific demarcation of constituencies, should according to the change of administrative division, population and other factors, in strict accordance with the proportion of legal principles, fully consider the floating population, minorities and women represent a ratio, the timely adjustment of the redistricting standard, representation of the distribution and the size of the district electoral division, avoid arbitrariness in the selection, ensure people enjoy equal rights to vote and stand for election; the supervision mechanism is necessary to establish Chinese redistricting, change the current at the county and township levels the NPC Standing Committee, the election commission has "player" when "referee" status, promote the redistricting open, transparent; at the same time also should establish the corresponding remedies law, the demarcation of constituencies into lawsuit scope, and the specialized agencies shall be resolved under the jurisdiction.
