The Research On Division Of The Copyright’s Income In Couple’s Mutual Property

With the rapid development of knowledge economy, the Copyright’s income has become animportant source of many current family income. But as our current legislation is not perfect,the property right income in the divorce property ownership and division is faced with differentdisputes and conflicts. In this paper, we, from the angle of legislation, try to analyse someissues about the property right income in the marital property classification and segmentation.In order to realize the fairness and justice in the property right income, we put forward soundsuggestions for a series of controversial issues about expectation interests in marital propertyownership and segmentation, based on national conditions, foreign legislative situation,legislation and judicial practice.The full text is divided into four parts:In the first chapter, by an introduction of a typicalcase, we raise issues related to the property right income in the marital property ownership andsegmentation. At the same time, we describe the importance of the property right income in thecouple’s mutual property segmentation.In the second chapter, based on different legislative principle of combining "marriagelaw" and the "copyright law" on theoretical analysis, we introduce related theory of theproperty right income and the marital community property, which provides theoreticalfoundation for the solution of the problems.In the third chapter, we discuss relevant provisions of the property right in the marriagelaw of our country, analyse their disadvantages, discuss in detail the difficulties and disputes ofthe property right income in marital community property, focuse on the predicament ofexpectation interests in marital community property, and comb the cut-in point to solve theproblems.The fourth chapter is about legislative proposals and improvement measures.
