| The outer space militarization trend hinder the peaceful use of outer spaceseriously, and it brings security threats to the international community. Since thebeginning of the new century, the outer space militarization measures unabated ofsome space powers, the peaceful use of outer space’s principle faces a severechallenge. The five outer space treaties due to their inherent defects limit the role toplay, however, in order to promote the demilitarization use of outer space, improvethe existing outer space legal system and build a related international cooperationlegal mechanism is the way to deal with this issue. This paper is from thisperspective to discuss the construction of international cooperation legal mechanismand then put forward own proposals on improving our country’s legislation of outerspace.Outer space international cooperation legal mechanism includes the followingthree mechanisms: First, the outer space security cooperation mechanism. Thismechanism can ensure to carry out the peaceful use of outer space’s principle, theUN and COPUOS will play an important role to reconstruct this mechanism; Second,the outer space administration and supervision mechanism. A unified administrationand supervision institution is important to the outer space resourses’ development,build the IOSA（International Outer Space Administration）can regulate outer spacedevelopment activities; Third, the outer space commercial dispute resolutionmechanism. There is a need to reconstruct a new commercial dispute resolutionmechanism to respond with outer space commercialization and privatization trend. Aseries of outer space achievements have been made in China, but lack of a relatedouter space law, so make a unified and comprehensive outer space law is thedirection of outer space legislation in the future. |
