As Hu Jintao said “Expand opening up in scope and depth and improve our openeconomy. Adhering to the basic state policy of opening up, we better integrate our bring inand go global strategies,…”, Chinese government takes a lot of measures to expand theareas of opening up, to raise the economic quality, to optimize the economic structure. Inthis sense, international investment and financing business has rapidly developed, and playsa more and more significant role in the development of Chinese economy and the realizationof national strategy. In the practice of international investment and financing, the contract isone of the most important legal documents to realize the strategy of investment andfinancing, which contribute to achieve the goal of the enterprise development. Consequently,accurate translation is the key for the communication between Chinese enterprises and theforeign companies. Recently, with the economic flourishing, an increasing number ofresearches on the International Business Contract (IBC) have been conducted by Chinesescholars. However, compared with other researches in the field of forensic linguistics, thestudy of IBC is very limited, especially the study of translation of specific internationalcontract with specific purpose is less than the common IBC, the lack of researchachievement in international investment and financing contract (IIFC) is an obviousexample. As IIFC is an important part of IBC, we should not only make progress from theforensic linguistic theory, but also combine the theory with practice to make it moreconducive to the practice of translation, and to provide some strategies or guidelines to thelegal practitioner and the translator.This thesis puts the Skopostheorie,a theory of translation criticism put forward byGerman functional scholars in the1970s, as the theoretical framework, to do a study aboutthe translation of IIFC. This thesis is divided into six chapters. Chapter one describes therationale, purpose, feasibility, and the arrangement of the research. Chapter two is literaturereview, which introduces previous studies about international business contract, and overviews the theoretical framework-Skopostheorie in detail. Chapter three demonstratesthe general introduction, and the language features from lexical, syntactic, textual level toIIFC. Chapter four analyses factors affecting the strategy choice, and examines howSkopostheorie works in the translation of IIFC. Chapter five puts forward strategies for IIFCin light of Skopostheorie. The final chapter is a conclusion for this thesis regarding to themain findings and limitations of this paper, and calls for more researches focusing on thisspecial translation area.By integrating theory with practice, this paper finds that it is possible to use theSkopostheorie in the IIFC translation. The translator should not only adhere to the traditionaltranslation methods, but also select the most appropriate translation strategy according to therequirements of the clients/initiator with different purposes, and the translation level can beupgraded by using of the Skopostheorie efficiently.
