The Research On Legal Regulations Of Excessive Discharge

Since1979when the Environment Protection Law was promulgated, the system oflegal regulations of excessive discharge was built. And that also brought good socialbenefits. With the development of society and economy, the excessive discharge increasedbut decreased. This means there are still lots of problems in the existing law andregulations. During enacting the law for more than30years lots of specific environmentallaws and regulations have been legislated and modified. From the practice, we could seesome negative effect in the lay enforcement. And there is a lacking of relevant in differentlaws and regulations, also misunderstand for the people who use the law.Concerning above problems, this paper will explain the basic theories and concept oflegal regulations about excessive discharge, and also explains the difference of relatedconcepts. Besides, some researches on the features of excessive discharge and currentsituation have been done. Secondly, this paper will analysis the shortage of the law andregulations from three respects: slight punishment, lack of information disclosure, anddisordered applicable conditions. Lastly, hope to regulate the excessive discharge bydiscussing the connection of punishments macroscopically. On the other hand to make theexcessive discharge regulations systematically，thus to save cost of enforcing the law forthe administration organization and make it easier to be understood by the public andenterprises.
