Research On Fog And Haze Pollution And Its Legal Control Means

The pollution of fog and haze, which is caused by many physical and chemical reasons, is a new kind of air pollution in China. In2012-2013, the large scale pollution of fog and haze was focused by mass media and the public. The pollution of fog and haze harms peoples’ health and the sustainable of the society and economy, so it is necessary to control the pollution of fog and haze. However, the pollution of fog and haze is complicated and cross regional, so the controlling should be scientific and reasonable. Controlling the pollution of fog and haze with legal means is the common means in different countries. The western countries also experienced serous air pollution in the process of industrialization, but these countries have solve the problems of air pollution and ensure the air is clean. How to deal with the tough problem of the pollution of fog and haze is still an issue to be researched. This dissertation researches the controlling of the pollution of fog and haze by legal means with the following parts: the first part is the brief introduction. This part introduces the background, main content, analysis means and new points as the start point of the whole research. The second part is the general situation of the pollution of fog and haze and its causes and harms. This part introduces and analyzes the pollution of fog and haze on basis of some data between the year2012to2013. The third part is the current situation and the problems existing in the controlling of the pollution of fog and haze. This part maintains that the Air Pollution Prevention and Control Law has not achieved its goal and there are also many deficiencies in law enforcement. The fourth part is the experiences of the developed countries which successfully solved the problems of air pollution。 This part introduced the experience of the UK, Japan, the United States and other countries and regions. The Clean Air Act of the United States is a great success in air pollution controlling and worth to be learned. The fifth part is the counter-measures in controlling of the pollution of fog and haze. This part put forwards many legal measures to control the pollution of fog and haze and lay much emphasis on scientific and targeted. The specific measures are as below: improve the standard of emission, increase the cost of law breaking， expand the scale of public participation, and enhance cooperation cross-regionally.
