Study On The Civil Liability Of Environment Infringement

With the worsening of pollution and deterioration of environment, environmental tort and civil liability will become a big social problem in China. This thesis takes the Civil Liability of Environmental Tort as a topic and discusses the civil liability of environmental tort systematically. Then the author puts forward some suggestions on the perfection of the legislation on environmental tort and civil liability in China. The thesis is divided into four parts:In the first chapter, the author defines the concepts and attributes of the environmental right, the environmental tort and the civil liability of environmental tort scientifically and exactly.In the second chapter, the author analyzes the civil liability system of environmental tort.In the third chapter, the author analyzes the correlation system in Japanese and American.In chapter four, the author puts forward some perfecting measures in our countryIn order to prevent environmental tort validly and protect people’s right, the author suggest that China should perfect the Environment Tort Law framework, the causal relation system; lay equal stress on the removing the endangerment and indemnity for damages; apply the principles of balance of benefits; expand the extent of compensation of environmental tort as well as a socialized environmental liability system.
