China, as a large agricultural country, the prevention and control of pollution of theagricultural land has a close relationship with the sustainable and healthy development of ourcountry’s social stability and economy. With the accelerating process of agricultural modernization,China’s agricultural land resources are over-developed. Along with the vigorous development oftownship enterprises, urban pollution enterprises have been transferred to the rural. Rural ownplanting, livestock breeding, garbage brought to the agricultural land pollution burden, leading tothe pollution of agricultural land is becoming increasingly prominent. Agricultural land pollutionis not only a direct impact on the security of the rural ecological environment, an adverse effect onour country’s agricultural production, and will seriously affect China’s food security, and thenendanger the physical health of the people of our country. Therefore, to enhance the preventionand control of pollution of agricultural land, protecting and improving the ecological environmentin rural areas, have reached a critical moment. How to take legal measures to combat agriculturalland pollution has become an important proposition which we have to face.Firstly, according to the characteristics of the agricultural land pollution, source type, hazardsand our agricultural land pollution overall condition, we will know the grim situation of thepollution control of agricultural land. Secondly, by sorting out the current relevant laws, affirmedthe positive of relevant laws of China’s the pollution control of agricultural land, but they are stillinadequate. Again, learning from the advanced experience of foreign countries, summed thelegislative characteristics of foreign agricultural land pollution control, and provided empiricalbasis for China to develop Agricultural Land Pollution Control Act. Finally, presenting legislationenvisaged of Agricultural Land Pollution Control Act on the basis, clearing legislative modelselection, legal idea, establish the basic framework of legislation and improve the basic legalsystem.
